A will is a legal document providing instructions for family members, heirs, and others, regarding a person's assets, debts, real estate, and personal property. If properly executed, a will provides clear directions for the personal representative to carry out the intent of the decedent.
However, oftentimes the terms of a will are ambiguous at best and it is unclear how the assets of an estate (or trust) should be distributed. Other times, questions arise as to whether the creator of a will (the testator) was competent to make decisions about the disposition of his or her property, and whether he or she was subject to the undue influence of another in drafting the will. The foregoing situations frequently give rise to a will contest or other Court proceedings, which may be required to determine the distribution under a will.
